Agreement to Terms
By accessing or using the services provided by Outreach ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you may not access our services.
Services Description
Outreach provides website design, development, hosting, and maintenance services for small businesses. Our services may include:
- Custom website design and development
- E-commerce website solutions
- Website hosting and domain services
- Website maintenance and updates
- SEO optimization services
- Technical support and consultation
Client Responsibilities
You agree to:
- Provide accurate and complete information for your project
- Respond to requests for feedback and approvals promptly
- Supply necessary content, images, and materials
- Ensure you have rights to all content you provide
- Make payments according to the agreed schedule
- Use our services in compliance with applicable laws
Payment Terms
- A 50% deposit is required to begin work.
- The remaining balance is due upon project completion, before the site goes live.
- All payments are non-refundable once work begins.
- Late payments may result in project delays, suspension, or late fees.
- Prices are subject to change with 30 days' notice (for future projects, not existing contracts).
Project Timeline
We strive to meet agreed timelines, but delays may occur due to:
- Client feedback or approval delays
- Scope changes or additional requests
- Technical complications
- Force majeure events
We will notify you promptly of any timeline changes.
Revisions & Scope Changes
The project includes a set number of revisions as agreed. Additional revisions or changes beyond the original scope may incur extra fees.
Intellectual Property
- Upon full payment, you own the rights to your custom website design and content.
- We retain rights to our proprietary code, frameworks, and development tools.
- Third-party components remain subject to their respective licenses.
- We may showcase your project in our portfolio unless you request otherwise in writing.
Limitation of Liability
Our liability is limited to the total amount paid for services. We are not liable for:
- Indirect, incidental, or consequential damages
- Loss of profits or opportunities
- Data loss or breaches outside our control
- Issues caused by third-party services or client modifications
Warranty and Support
We provide a 30-day warranty after project completion covering:
- Functionality issues
- Cross-browser compatibility
- Mobile responsiveness
- Basic bug fixes
This warranty excludes issues arising from third-party services, plugins, or unauthorized changes. Additional support is available via our maintenance packages.
Termination
- Either party may terminate services with written notice.
- We may terminate for non-payment or breach of terms.
- You may terminate at any time, but deposits are non-refundable.
- Upon termination, we will deliver all completed work to date.
- You remain responsible for outstanding payments.
Confidentiality
We will keep your business information and project details confidential, except where disclosure is required by law.
Force Majeure
We are not responsible for delays or failures caused by events beyond our control, including but not limited to natural disasters, government actions, internet outages, or third-party service failures.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. Disputes will be resolved in the appropriate courts or via arbitration where applicable.
Changes to Terms
We may update these Terms from time to time. Updates take effect immediately upon posting. Continued use of our services constitutes acceptance of the revised Terms.
